The regulation of the federal government according to §26 of the Energy Security Act on financial compensation through a balanced price adjustment (Gas Price Adjustment regulation) came into force on August 9, 2022. According to the regulation, the gas importers directly affected by a significant reduction in the total gas import volume are entitled to financial compensation for the additional costs of replacement procurement, provided that the gas procurement contracts were concluded before May 1, 2022. Compensation claims for the affected additional costs only exist from October 1, 2022. The compensation claim is directed against the market area manager in accordance with the regulation.
Corresponding compensation claims must be sent to the market area manager within 4 working days after the regulation comes into force. Up to this point, THE has no detailed knowledge of which companies are potentially entitled to financial compensation or which additional costs are reported accordingly. In accordance with the Gas Price Adjustment regulation, the market area manager is entitled to pass on the costs incurred in connection with the payment of the compensation to the balancing group managers in the market area as a gas procurement neutrality charge. The gas procurement neutrality charge valid from October 1, 2022 will be published on August 15, 2022.
